EC Has No Power to Denotify Any Party: PMLN Counsel

Islamabad (September 26, 2017): The lawyer of Pakistan Muslim League (N) Jehangir Jadoon argued before the four-member bench of Election Commission Pakistan (ECP)in the case pertaining to the cancellation of the registration of the party.

Arguing his case before the four-bench of the ECP headed by Chief Election Commissioner Sardar Muhammad Raza Khan the PMLN counsel challenged ECP’s power saying that it has no authority to denotify a political party.

Jadoon who also submitted separate replies to various petitions seeking denotification of PMLN as a political party also argued that a political party could not be denotified on the wish of an individual or a petitioner.Calling the allegations leveled by the petitioners mala fide the counsel of the PMLN said the Article 17 of the constitutions prescribes the procedure to denotify a political party. The allegations are only aimed at blackmailing and harassing.

Calling the allegations leveled by petitioners baseless and illogical  Jadoon argued that there is no law that stops an ineligible person to head a political party, Jadoon argued.

The ECP later adjourned the hearing till October 18.

It may be mentioned here that on August 17 Islamabad High Court (IHC) had issued notice to Election Commission Pakistan (ECP) over hearing of petition seeking cancellation of party registration of Pakistan Muslim League (Nawaz) (PMLN). Justice Amir Farooq directed the EC to hear the said petition to and decide it. The petition pleads IHC to order ECP to grant hearing of petition seeking cancellation of party registration of PMLN.The IHC had issued the direction to the ECP on the petition filed by Raees Abdul Wahid advocate who had before the court on August 17  that Nawaz Sharif cease to be the head of PMLN after being disqualified by the Supreme Court in Panamagate case.

Arguing that Nawaz Sharif could not head a political party while on ECP’s website is name appears as the president of PMLN party the petitioner had plead the court to only order removing Nawaz Sharif’s name from the ECP website but also PMLN’s registration with ECP should also be terminated.
