Election as PMLN Pres: IHC Directs Nawaz to Submit Reply

Islamabad (October 30, 2017): Islamabad High Court (IHC) has directed disqualified prime minister Nawaz Sharif to submit reply by November 14 in the petition challenging his election as president of PMLN.

The IHC  issued a written order for fixing the date for the hearing of the petition challenging Nawaz’s election as party president. On the order of the court the Registrar Office of the IHC has sent a notice to the ousted prime minister.

Notices have also been issued to federal Secretary Law, Secretary Establishment Division, Chief Election Commissioner, and Secretary Election Commission Pakistan on the petition filed by Makhdoom Niaz Inqalabi and Abrar Raza. The petitioners challenge Sections 232 and 203 of the Election Act.

It may be mentioned here that  on the ninth of this month the court had issued notices to ousted prime minister Nawaz Sharif, Attorney General, Chief Election Commissioner, Secretary Election Commission, Secretary Establishment Division in the case challenging Nawaz being elected president of Pakistan Muslim League (N). The written order pertains to the notices that it issued then.

IHC will hear the case on November 14.

 

Petitioner Makhdoom Inqalabi advocate argues that Election Act 2017 passed by the National Assembly and the Senate recently that allows a disqualified person to head a political party is in violation with the basic structure of the constitution.

The petitioner further argues that various cases seeking Nawaz’s election as party president and cancellation of the registration of PMLN are under hearing at various courts pleads the court to stop Nawaz Sharif engage in political activities as the president of PMLN till these cases are disposed by the court.

He pleads that till the disposal of the pending application, implementation on section 203 and 232 of Election Act be stayed. The petitioner has also pleaded the court to declare the Election Act 2017 as ultra vires of the constitution.

It is to be mentioned here that the General Council of Pakistan Muslim League-Nawaz (PML-N) had re-elected Nawaz Sharif as party chief by amending its constitution allowing a person ineligible or disqualified to be member of the parliament to head the party.
