5 IHC Judges raised seniority issue once again

ISLAMABAD: Five judges of the Islamabad High Court (IHC) have raised the issue of seniority once again. The five judges have submitted a representation to the Chief Justice of the Islamabad High Court regarding the seniority list.

According to sources, a copy of the judges’ representation has also been sent to the Chief Justice of Pakistan, Justice Yahya Afridi.

It is noteworthy that the seniority list of the judges was issued yesterday with the approval of the Chief Justice of Islamabad High Court, Justice Amir Farooq.

The judges who have raised the seniority issue include Justice Mohsin Kiani, Justice Tariq Mehmood Jahangiri, and Justice Babar Sattar. Justice Sardar Ijaz Ishaq Khan and Justice Sameen Rafat Imtiaz are also among those who sent the representation.

Sources suggest that Justice Mian Gul Hassan Aurangzeb and Justice Arbab Muhammad Tahir are likely to file separate representations.

According to the judges’ representation, it is stated that a judge takes an oath for the high court in which they are appointed. As per the Constitution, when a judge is transferred to another high court, they must take a new oath, and their seniority in the new high court will be determined based on the new oath.

Judicial sources have stated that the representation filed by the judges is related to seniority and has nothing to do with judicial transfers.

The representation also requests Chief Justice Yahya Afridi to postpone the Judicial Commission meeting until the seniority issue is resolved.
