SC releases detailed verdict of PTI reserved seats case

Islamabad:The Election Commission of Pakistan (ECP) failed to play its due rul e in the general election hel d on February 8, 2024 while the Pakistan Tehreek-e-Insaf is legitmate to get reserved seats.

The Supreme Cout of Pakistan has issued a detailed decision of it verdict pronouned on July 12 over the allotment of reserved seats.

The detailed decision comprising 70 pages whereas it is written by senior judge Justice Mansoor Ali Shah.

Annulling the Peshawar High Court (PHC) verdict the detailed decision said that the people of the country is the supreme stake in an election adding that an election dispute is different from other civil disputes.

The court said that they thought a lot how larger number of independent candidates can be victorious being in political system based on political parties and parliament democracy?

No satisfactory answer of this question has not been given while the PTI claimed that the independent candidates were its candidates and voters voted for them being the candidate of the PTI.

The detailed judgment said that there is no legal status of the ECP decision taken on March 1. Whereas the ECP decision is in clash with the constitution.

The PTI is a political party and we have petition of the PTI in front of us to become party in the case, the detailed decision said.

Usually first decision has been taken regarding to become party in the case . This court has many a times have said that for the disposal of the justice the court is not bind to follow any technical principle.

Not giving a election symbol can not affect a political party legal and constitutional right of contesting the elections, the judgment said.

The constitution or law can’t stop a political party to file its candidate in the election adding that for people wishes and democracy transparent election is necessary.
