SC declares trials of civilians in military courts null and void

Islamabad: Supreme Court on Monday declared trials of civilians in military courts null and void in the petitions against trials of civilians in the military courts.

The SC larger five-member bench headed by Justice Aijaz Ul Ahsan,comprising Justice Munib Akhtar, Justice Yahya Afridi, Justice Sayyed Mazahar Ali Akbar Naqvi, and Justice Ayesha Malik heard the petitions against the trials of the accused in the military courts.

Head of the bench read the short order in the court.

The top court pronounced the verdict with a majority of 4-1 votes.

As the court declared the civilians trials in the military courts null and void, the court approved the petitions against trials of civilians in the military courts.

The SC in its orders said that civilians can’t be tried in the military court and they will be tried in the civilian courts.

The military courts clauses regarding the trials of the civilians in the military courts declared unconstitutional.

Justice Yahya Afridi expressed difference over the army act 2(1) D (1) and 2(1) D(2).

The court disposed of nine petitions over not having affidavits with it.
