Any legislation against constitution can’t be retained: Justice Amin Uddin

Islamabad: The Supreme Court (SC) on Friday, today, resumed hearing of the intra-court appeals against trials of civilian in the military courts.

A seven member larger bench headed by constitutional chief Justice Justice Amin Uddin comprising Justice Jamal Mandokhail, Justice Muhammad Ali Mazhar, Justice Hassan Azhar Rizvi, Justice Musarat Hilali, Justice Afghan and Justice Bilal Shahid.

Justice (retd) Jawad S Khawaja counsel Khawaja Ahmed Hussain in his arguments said that the army act applicable on civilian employee of the Pakistan Army.

Justice Musarat Hilali questioned “What is the difference between civilians in two different incidents of army public school terrorists attack December 16 2014, , and May 9, 2023 protest?

Chief Justice Amin Uddin remarked there is no other opinion that no legislation can be retained against the constitution.

The court also expressed anger on Latif Khosa over speaking sitting at his chair.

The court adjourned the hearing till Monday, February 3rd.
