Can Armed forces under executives use its courts authority?

ISLAMABAD:The Constitutional Bench of the Supreme Court of Pakistan (SCP) continued Thursday, hearing of the intra-court appeals against trial of civilians in military courts.

The seven-member Constitutional Bench of the Supreme Court, headed by Justice Amin ud Din Khan and comprising Justice Jamal Mandokhail, Justice Muhammad Ali Mazhar, Justice Hasan Azhar Rizvi, Justice Musarrat Hilali, Justice Naeem Akhtar Afghan and Justice Shahid Bilal Hasan was conducting the proceedings.

Advocate Aziz Bhandari, Counsel for Founder PTI was arguing before the court and said that we are to see what is allowed in the Constitution and what is not.

The PTI founder counsel said that routine amendments in the Constitution cannot suspend the fundamental rights of the citizens.

He continued that the nature of crime can’t end fundamental rights adding the army act linked with discipline only.

Justice Amin ud Din Khan remarked that the armed forces members will apprise about the nature of the crime.

Justice Mandokhail said that under the constitution, the armed forces come under executives while he questioned that do the forces under the executive can use its court authority? Should courts be free or not?

The Court adjourned the hearing for Monday, February 24 while Advocate Aziz Bhandari will continue his arguments.
