Islamabad: Supreme Court of Pakistan (SCP) has disposed of the ministry of defence petition seeking elections across the country while declaring the petitions non maintainable.
The SC has issued a written orders regarding the hearing held today over holding of general elections and elections in two provincial assemblies.
The court orders said that the petitioner counsel talked of dialogue in the existing situation which is welcoming adding that the SC has given verdict regarding elections on April 4.
The order said that the petitioner has given an opinion to hold elections across the country on same day, however, the process of elections will be better with consensus opinion of the political parties.
The SC in its order categorically said that there is no other way out to end the SC verdict of holding elections. The SC as per the constitution has passed its judgment. the order reads.
The constitution says holding of elections after 90 days of dissolution of assemblies while clearing that political negotiations should not be conflicting to the constitutions. the order added.
The SC in its order said that the defence ministry has insisted the court to withdraw the verdict of April 4 adding that the insistence is not maintainable and no relief can be given on it.
The court can’t accept the defence ministry insistence while the top court also rejected the Election Commission of Pakistan (ECP) point of view and said that the ECP wanted to bring the court process to its start.
The ECP in its report insisted the court to restore earlier date of elections, October 8 owing to basis of the security reasons. The SC said that the purpose of the court orders is to implement prohibition mentioned in the constitution.
The court orders warned that a violation or disobedience to the court orders can result into grim consequences. The court in its order clearly ordered the federal government to release Rs 21 billion to the ECP till April 27.
