CII Undecided Over Punishment On Triple Talaq  

Islamabad (September 26, 2018): The Council of Islamic Ideology (CII) could not decide the punishment of triple Talaq but chairman Dr Qibla Ayaz said on Wednesday that the authority supported the decision of deeming triple Talaq, divorce, in one sitting as punishable.

During the meeting, a suggestion of 0.1 million fine and one-year punishment appeared but members were not agreed.

The chairman was addressing media after a CII session, where he said that three times ‘divorce’ at the same time has emerged as a pertinent issue.

He said that the punishment regarding this will be discussed with religious scholars and also on making a consolidated divorce paper.

Dr Ayaz said a session will be summoned on the issue of triple talaq soon.He further said the CII discourages marriages of minors.

On November 3, Dr Qibla Ayaz was appointed the chairman of the Council of Islamic Ideology (CII), Pakistan’s top Islamic advisory body, for a period of three years. He replaced Maulana Muhammad Khan Sherani, a politician from the Jamiat Ulema-e-Islam-Fazl, who headed the Council for six years.

The CII was first set up in 1962, during the term of Gen Ayub Khan. Its mandate was and is to assist the government in Islamising the laws.

On September 19, India’s Union Cabinet approved the Triple Talaq ordinance, which makes instant divorce a penal offence. The ordinance demands that Muslim men found guilty of the offence be fined and jailed for three years.A modified of Talaq (divorce), Triple Talaq is not as per Quranic principles or teachings. For talaq-e-sunnah (Islamic divorce), the Quran purports efforts of reconciliation and giving notice to the wife over an extended period of up to three months, with the pronouncement of ‘talaq’ staggered over this period of time.

When the third and final ‘talaq’ is given, even after the conciliatory efforts and the breaks in between, the divorce is deemed final and therefore irrevocable.
