SC Seeks Reply From Accused Named in Asghar Khan Case

Islamabad (June 06, 2018): Supremo of PML-N and Former Prime Minister on Wednesday failed to appear before the Supreme Court despite a summon.

A three-member bench headed by Chief Justice of Pakistan, Justice Mian Saqib conducted hearing of the case. Where is Mr Nawaz Sharif?” asked the CJP over his absence.

“His notice was collected by his security officer. Contact him and ask him to reach court within an hour,” directed the CJP.

CJP directed Attorney General to ask Nawaz Sharif to arrange a lawyer if he is unable to attend the hearing.”“Nawaz Sharif is in accountability court. He is preparing for a lawyer to represent him in the case,” replied the Attorney General.

During hearing, Aitzaz Ahsan appeared before SC and informed SC that Khurshid Shah is in Karachi and his name is not among the recipients of the money.

The court admitted its mistake of sending notice to Khursheed Shah by mistake.Mirza Aslam Baig also appeared in the court. ” I request the court to decide over my case and not the army,” he said. “Submit your petition and we will review it. The next hearing of the case will be held in Lahore,” remarked the CJP.

Earlier today, Senior Politician Javed Hashmi appeared before SC and raised allegations over Intelligence Agencies of the country of distributing money to the politicians.

“I came to appear before the court in respect of the judiciary. The accusation against me is entirely false. FIA also held interrogation and cleared me,” Javed Hashmi said.“Your appearance in the court is commendable. You are a beacon for others,” said the chief justice.

“Whoever is accused of receiving money will appear before the court, retired army officers will also have to face trial, CJP made it clear. The accused should provide an explanation as they are being given a chance. Don’t lament afterwards,” remarked the CJP.Later talking to media, Hashmi said, “the case accuses that ISI gave money to some people and politicians have been named, if politicians raise allegations, they are labelled as a traitor.

I do not have any idea about this. I was acquitted after the five-year jail term. The real clash was between PML-N and PPP. Politicians are used and then thrown away.”

The next hearing will be held on June 12 in Supreme Court Lahore registry.

Yesterday, the Supreme Court of Pakistan summoned former prime minister Nawaz Sharif in Asghar Khan case on Wednesday(today).

The apex court registry had issued notices to 31 respondent in the case. Court had also severed the notices to Abida Hussain, Altaf Hassan Qureshi, MQM founder Altaf Hussain, Javed Hashmi, Jam Mashooq, Ajmal Khan, Afaq Ahmed, Khursheed Shah, Ghulam Mustafa Khar and Sirjaul Haq.

On June 01, Attorney General of Pakistan was summoned by the Supreme Court of Pakistan in a case pertaining to implementation of the verdict in Asghar Khan case.

A three-member bench headed by Chief Justice Saqib Nisar heard the case in SC Lahore registry.

Deputy attorney general told the court that the cabinet has taken a positive decision. “The attorney general will appear before the court and inform about the decision,” he said.The Chief Justice expressed resentment over the absence of attorney general and remarked, “The hearing of such a significant case is underway but he is not concerned. Federal Investigation Agency (FIA) Director General appeared before the court and told that inquiry into the matter is underway.

CJP remarked that why hasn’t the federal cabinet done anything regarding the Asghar Khan case verdict, adding that this is a serious case and government is least concerned about it.The lawyer of federal government requested the court to grant him respite in calling the cabinet meeting.

Asghar Khan Case:

In 1996, Air Marshal Khan had filed a human rights petition in the Supreme Court of Pakistan, accusing the Inter-Services Intelligence (ISI) of doling out money to a group of politicians in the 1990s.

The case was initiated by the air marshal after Benazir Bhutto’s interior minister, retired general Naseerullah Babar, had disclosed in the National Assembly in 1994 how the ISI had disbursed funds to purchase the loyalty of politicians and public figures so as to manipulate the 1990 elections, form the Islami Jamhoori Ittehad (IJI), and bring about the defeat of the PPP.Image result for Asghar Khan Case: Beg, Durrani Review Petitions Rejected16 years after the petition was filed, the Supreme Court in its judgement — penned by then chief justice Iftikhar Chaudhry — ruled that the 1990 general elections had been polluted by dishing out Rs140 million to a particular group of politicians only to deprive the people of being represented by their chosen representatives.

The court had, however, thrown the ball back to the then PPP government by directing it to take necessary action under the Constitution and law against former army chief retired Gen Aslam Beg and former director general of Inter-Services Intelligence retired Lt Gen Asad Durrani for their role in facilitating the group of politicians and political parties to ensure their success against their rivals in the 1990 elections.

In May 2017, PTI had announced its decision to file in the Supreme Court a petition seeking implementation of the orders of the already decided case.
