ECP Rejects PTI Reference Against Gulalai

Islamabad (October 124, 2017): The Election Commission of Pakistan (ECP) on threw out a reference filed by Pakistan Tehreek-e-Insaf (PTI) seeking the commission to de-seat its dissident MNA Ayesha Gulalai for violation of party discipline  and policy. 

A five-member bench of ECP headed by Chief Election Commissioner Justice (retd) Sardar Raza Khan heard the reference filed by PTI. After hearing arguments of PTI and Gulalai’s counsels the Commission reserved its verdict.

Later the commission announced its short order. The ECP rejected the PTI reference seeking to denotify Gulalai as member of National Assembly with a majority verdict.

Chief Election Commissioner and members of ECP from Sindh and KP ruled that PTI reference ought to be struck down while members of ECP from Punjab and Balochistan gave dissenting notes, adding that Gulalai should be de-notified as MNA for violating party rules.Earlier PTI counsel Sikander Mohmand said that it was the party leadership’s prerogative if they want to take action against someone.The lawyer said that Gulalai said she couldn’t attend the assembly session when the new prime minister was elected due to illness but the same day she conducted a press conference.

Gulalai’s lawyer, in turn, said that her client’s response to the PTI show cause notice wasn’t accepted.

“The PTI’s stance that it didn’t receive the answer to the show cause notice is incorrect,” said the lawyer.In the previous hearing on Oct 17, Imran’s lawyer reiterated before the commission that Gulalai announced to leave the party and then backtracked from her statement.

“Gulalai leaving party but not leaving assembly membership is not possible as per the party Constitution,” said the lawyer.

Gulalai’s lawyer barrister Masroor rejected PTI accusations and said that expressing the desire to leave party and actually resigning are not the same thing.

Gulalai has never tendered her resignation to the party and said that she isn’t leaving PTI in National Assembly, Masroor said.
