Even Don’t Want to Visit Bahria Town: CJP Saqib Nisar

Islamabad (September 12, 2018): The chief justice of Pakistan Justice Mian Saqib Nisar on Wednesday, while hearing a case over Bahria town review petition, said that court can’t close its eyes over the land dispute.

Five-member larger bench of SC heard the Bahria town case.

As the hearing started, CJ asked,  “how can Sindh government affect from court verdict.”

Responding judge remarks Sindh government lawyer Farooq H Nike said that the burden of the court decision will fall on officials who had allotted the land.“Any person what he sows will reap,” reply the CJ adding that the limitation of review petition is restricted them to not widen the case.

In his remarks, Malik Riaz told the court, “You can observe Bahria town by visiting the site, however, if you don’t want then may send any person to visit the projects as the middle calls being provided facilities there.

the Top judge said in his remarks, “I even don’t want to visit the site.”

Bahria Town lawyer informed the court that Bahria town has 12000 care of the land and the land was exchanged with Malir Development Authority (MDA) through Sindh Board of Revenue.“If court reached on a judgment that the exchange of land based on the secret deal that the complete structure of the Bahria Town would be abolished,” CJ said in his remarks adding that Bahria Town has illegal possession on MDA land and it should be returned to MDA.

“What the court will decide over the cost of the land Bahria Town will have to pay,” CJ warned.

Bahria Town lawyer told the court that the land had given to Bahria Town under the colonization of land act.

On which justice Asif Khusa remarked, “You must not discuss this act as it will further deepen your problems because under this act land can’t be transferred or exchanged.”

CJ warned that the court will not allow anyone to plunder the state land.

The hearing of the case adjourned till October 1.
