Fahad Malik Murder Case: Petitioner Counsel Concludes Arguments

ISLAMABAD:  The petition against the release of prime accused in Fahad Malik murder case by the lower court was heard in Islamabad High Court (IHC) while the petitioner completed its arguments.

The IHC two-member bench consisting up of Justice Amir Farooq and Justice Mohsin Akhtar Kiyani heard the petition against the release of the prime accused Arshad Malik in the Fahad Malik murder case by the lower court.

Prime accused Raja Arahad counsel said that the IHC had suspended the release order of Arshad Malik until the next hearing.

On which, the court asked where is the petitioner? While assistant of the petitioner told the court that he is sick.

Raja Arshad counsel contended that the petitioner should go respective forum first before coming to the IHC and said that the petition is not maintainable.

The IHC bench said that the mother of Fahad Malik is not the complainant in the FIR and when the mother is not the complainant then how the petition can be filed?

The petitioner assistant lawyer argued that lower court had not authorized to grant bail to Raja Arshad adding that one who arrested on terrorism cannot be granted bail while Arshad Malik has been arrested from Torkham border in his attempt to run away from the country after getting bail from Multan High Court Bench earlier.

After the conclusion of arguments from the petitioner the court has directed Raja Arshad counsel to present his arguments in the next hearing on May 22 and adjourned the hearing till then.

Fahad Malik a barrister was brutally gunned down in F-10/3 in the wee hours of August 15.
