How PM Can Order Induction in NAB, Wonders SC Judge

Islamabad (June 20, 2017): Supreme Court on Tuesday heard review petition filed  by a former sportswoman and Director General Awareness and Prevention Cell National Accountability Bureau (NAB) Aliya Rashid against the apex court decision removing her from the Bureau.

A three member bench of the apex court heard the review petition.

Aliya Rashid had challenged the verdict of the Supreme Court of March 29, 2017, removing three military officials and a civilian who were inducted into the Bureau with inherent disqualification.

On March 29, 2017, a three-member bench of the apex court headed by Justice Ameer Hani Muslim, had issued a verdict in a suo moto case regarding alleged illegalities, contraventions and violations in appointments in the anti-graft body.

The court had directed removal of DG NAB, Lahore Major (R) Burhan Ali, DG NAB Karachi Major (R) Shabbir Ahmed and DG NAB, Balochistan Major (R) Tariq Mehmood Dawar and Aliya Rashid a sportswoman and DG NAB, Awareness and Prevention.

These four officers had refused to opt for premature retirement and opted for contesting the case. Aliya was appointed by former Prime Minister Mir Zafrullah Khan Jamali.

The court, however, had observed that she could be appointed as DG Sports, secretary Sports or elsewhere but not in NAB which deals with investigations.

During hearing of the petition on Tuesday, Justice Asif Saeed Khosa remarked that how the Prime Minister can order induction of sportswoman in NAB.

He remarked that NAB must have to file reference against the PM at the time it was instructed to induct the woman in the body.

Khosa remarked that if an anti-graft body would comply with Prime Minister’s orders then where people will go.

Alya’s counsel said that players were adjusted in different departments as per policy.  Upon this, Justice Khosa questioned whether players would also be inducted in nuclear reactor as per the policy.

He wondered as to how Prime Minister can ordered induction in NAB.  The judge said that against such appointments NAB take action.

While addressing the petitioner counsel, Justice Khosa said whether he wanted the court to order to file reference against the former Prime Minister.

Justice Faez Essa said that whether there was any law governing appointment in NAB or Prime Minister order was itself a law.
