ICJ Fixes Date For Hearing of Kulbhushan Case: Sources

Web Desk (August 22, 2018): The International Court of Justice (ICJ) has fixed February 2019 as the window for the hearing case of convicted Indian spy Kulbhushan Jadhav, said sources on Wednesday.

The world court will hear the case daily for a week in February next year, the sources said.

India had moved the ICJ against the case, after Jadhav — an on-duty Indian navy officer — was arrested and sentenced to death by Pakistan for espionage and subversive activities last year.India had submitted its pleadings to the ICJ on September 13, 2017. The Indian stance was dismissed by Pakistan in its counter-pleadings, which were submitted on December 13 that year.

In its counter-memorial, Pakistan had stated that Jadhav is not an ordinary person as he had entered the country with the intent of spying and carrying out sabotage activities.The reply also stated that Jadhav, who was a serving officer of the Indian Navy, does not fall under the purview of the Vienna Convention.

Earlier on April 10, 2017, Indian spy Kulbushan Jadhav was awarded the death sentence.

DG ISPR further said that the spy of Indian covert agency RAW, who was arrested from Balochistan on March 3, 2016, was awarded the death penalty after he was found guilty of all the charges for subversive acts to harm the sovereignty of Pakistan.

Indian spy Kulbhushan Jadhav, who worked under the name of Mubarak Hussain,  had confirmed during the hearing that he was sent to Pakistan by RAW and was facilitating terrorist in Karachi and Balochistan.

Army Chief General Qamar Javed Bajwa confirmed the death sentence.

On May 18 2017, the International Court of Justice stayed execution of Indian spy Kulbhushan Yadav till it decides the case.

The Court reserved the judgment over Indian application challenging awarding of death sentence to spy of Indian covert agency RAW Kulbhushan Yadav on May 15 and announced on May 18.

The verdict was read by the president of the court Ronny Abraham.
