IHC Returns NA-15 Recounting Issue to ECP

Islamabad (August 06, 2018): The Islamabad High Court (IHC) had returned the issue of recounting on NA-15, Kark, to Election Commission of Pakistan (ECP) while reserved the verdict on PP-241 recounting plea on Monday.

According to details, IHC judge justice Umer Farooq after hearing the plea filed by PTI leader Ali Asghar for recounting on NA-15 has returned the case to ECP.Justice Umer Farooq said in his remarks that he could understand how Lahore High Court (LHC) has issued orders of recounting while as per law after the consolidation the recounting can’t have happened as the decision of assessment of facts and recounting can only be made by the election tribunal.

In another plea against the rejection of recounting request in PP-241 court has reserved the verdict.

PTI leader Muhammad Muzaffar,s lawyer Muhammad Sarwar told the court that recounting of votes was the right of the candidate, therefore the court should order the recounting on PP-241 under the sub-clause of article 95 of election act.
