Justice Khosa To Hear Acquittal Plea Against Khadija’s Attacker

Lahore (June 10, 2018): CJP on Sunday has ordered that Justice Asif Saeed Khosa will hear the appeal against Lahore High Court’s (LHC) acquittal of a man earlier convicted for brutally attacking law student Khadija Siddiqui with a knife.

A two-member bench headed by CJP, heard the Khadija stabbing case.

The CJP had summoned the case’s record on Tuesday, a day after Justice Sardar Ahmed Naeem of the LHC, through a short order, acquitted Shah Hussain of all charges after accepting his appeal against the five-year sentence handed to him by a sessions court.

During the hearing of the case today, the CJP questioned Hussain’s father, “How did you run a campaign against the apex court?”

“Had something similar happened to the daughter of a lawyer, would your attitude have been the same?” he further asked him.

Meanwhile, Khadija informed the court, “I have become a target of the character assassination.Justice should be done in my case,” she asserted.

Earlier a protest was held outside the supreme court’s Lahore Registry by Khadija and civil society before hearing of the case.

On June 05, Chief Justice of Pakistan (CJP) Mian Saqib Nisar taken notice of Lahore High Court’s acquittal of Shah Hussain, the man who was convicted of brutally stabbing law student Khadija Siddiqui two years ago.

Justice Nisar had summoned record of the case at the top court’s Lahore registry on Sunday(today).

Earlier, the Lahore High Court (LHC) on Monday acquitted Shah Hussain, who had been sentenced for attacking Khadija Siddiqui.The decision was announced by LHC judge, Justice Ahmed Naeem after hearing arguments from both parties.

In July 2017, Shah Hussain was found guilty of stabbing Khadija at least 23 times on Lahore’s Davis Road. The single bench of the LHC acquitted the convict today, giving him the benefit of doubt after he appealed against his four-year sentence.

During the proceedings, the convict’s lawyer stated that his client has been facing punishment over baseless allegations.

He said that Shah Hussain was not present at the time of the attack and the evidence against him is insufficient. Following the arguments, the LHC acquitted the convict from a four-year sentence.
