NA-249: Shehbaz Moves SHC Against Faisal Vawda’s Victory

Karachi(August 7, 2018)Pakistan Muslim League-Nawaz (PML-N) President Shehbaz Sharif on Tuesday challenged the results of NA-249, Karachi constituency in the Sindh High Court.

In his petition, Shehbaz requested for a vote recount in the constituency.

The SHC approved Shehbaz’s request. The hearing of the petition is expected to be conducted today.PTI’s Faisal Vawda won against Shehbaz from the constituency during the July 25 polls. Vawda had received 35,344 votes while Shehbaz bagged 34,626 votes.

Earlier, President Pakistan Muslim League-Nawaz (PMLN) Shehbaz Sharif on Sunday requested the Election Commission of Pakistan for re-count on NA-249 (Karachi)

Pakistan Tehreek-e-Insaf (PTI) candidate Faisal Vawda won against Shehbaz on the constituency. Vawda received 35,344 votes while Shehbaz managed to bag 34,626.Shehbaz in his request filed through Barrister Zafarullah maintained that the vote count was not done appropriately and the returning officer manipulated the form 45. The PML-N president said that the difference between rejected votes and the margin of winning votes is marginal.He requested the ECP to null and void the polls held on the constituency and to not issue the notification of election result.

Earlier, LHC restrained the ECP from issuing the victory notification of former foreign minister Khawaja Asif in NA-73 Sialkot constituency.

LHC Justice Mamoonur Rasheed announced the decision on petition filed by Pakistan Tehreek-e-Insaf (PTI) leader Usman Dar and issued notices to the electoral commission and Khawaja Asif.Dar, in his petition submitted through Advocate Anees Hashmi and Advocate Tajamul Gondal, had challenged the victory of Asif pleading that the returning officer did not provide Form-45 to the polling agents.

The PTI leader maintained that as many as 7,346 votes were dismissed in his constituency and he lost to the PML-N leader by a margin of 1,406 votes.

The petitioner’s counsels asked the court to stay the notification of Khawaja Asif and order the returning officer to hold recounting of complete ballot papers.

Meanwhile, the Election Commission of Pakistan (ECP) is going to notify newly-elected members of the national and provincial assemblies later today.A summary of issuing notifications to successful candidates has been sent to the chief election commissioner.

However, notifications of candidates in constituencies that have been challenged in courts will remain withheld, which will be issued after the verdicts of the cases are announced.

Notifications to successful candidates from more than 30 constituencies have been withheld. Polls were delayed on two seats of the National Assembly and six of provincial assemblies. Elections for these seats will be held within 60 days after newly-elected members of the national and provincial assemblies take oath.After the successful candidates are notified, their independent counterparts will have three days to join a party. The final list of positions of parties will then be issued.

The notifications to successful candidates from reserved seats will be issued after the final list of positions of political parties is compiled. Candidates from reserved seats will be notified within two days after independent candidates join political parties.

According to the electoral body, political parties have submitted their lists of preferences for reserved seats.

Assembly sessions will be called after the electoral body will have notified all successful candidates. After taking oath in the National Assembly, candidates will elect the speaker of the House along with the prime minister.Pakistan voted on Wednesday, July 25, 2018, for the country’s second consecutive democratic transfer of power. Voters from 85,307 constituencies of the national and provincial assemblies cast ballots in favour of the 11,855 contesting candidates.

With 117 seats, Pakistan Tehreek-e-Insaf (PTI) emerged as the winner in the National Assembly. The party also bagged the most votes in Khyber Pakhtunkhwa — where it ruled for the past five years.

In Punjab, Pakistan Muslim League-Nawaz emerged as the single-largest party in the provincial assembly with 129 seats, while the PTI has a tally of 123. The Pakistan Muslim League-Quaid-e-Azam has eight MPAs after the joining of an independent member, while the PPP has six. There are 28 independents in all.
