Pic Leak, Hurdles in JIT Probe: SC Seeks Reply from AGP

Islamabad (June 12, 2017): The three-member special implementation bench of the apex court on Monday adjourned hearing of  Hussain Nawaz’s application over picture leak till Wednesday.

When the implementation bench headed by Justice Ejaz Afzal Khan resumed hearing of the application filed by Prime Minister’s son Hussain Nawaz against his picture leak, head of the joint investigation team (JIT) Wajid Zia submitted reply in a sealed envelope over the issue.

The JIT is currently investigating money laundering allegations against Prime Minister and his family.

The bench sought reply from Attorney General for Pakistan over picture leak and hindrances in investigation by the JIT.

Upon this, Hussain Nawaz counsel Khwaja Haris submitted that the court also need to look into video recording of the proceeding by the JIT. He argued that the JIT had not power to record investigation.

Upon this Justice Ejaz Afzal Khan remarked that there was no bar on recording in Section 161 and 162 of CrPC.  Justice Ejaul Hassan said that though the video recording could not be used a evidence but there was no bar on recording.

He added that the JIT had limited time frame to complete the investigation so it was recording the proceeding to make correct.

Addressing Khwaja Haris, the bench said that JIT in its reply had refuted many allegations. The bench advised Haris to go through the reply of JIT in the matter.

Justice Ejazul Ahsan said that the JIT had raised serious questions. If the issue raised by JIT of hindrances and threats were true then those creating the hindrance would have to face consequences, he remarked.

He added that not only hindrances were created for the JIT but records were also being tempered with, which was a serious issue.

The bench also sought reply from Attorney General for Pakistan over the letter of President National Bank Saeed Ahmed against the JIT.

The bench questioned as to how a head of a national institution can wrote such a letter against the JI and even the letter was issued to media.

All the six members of Panama JIT, Hussain Nawaz counsel, General Secretary PTI Jahangir Tarin, PTI leader Usman Dar and others were in attendance in the court room.

The members of the bench after reviewing the reply submitted by JIT head over picture leak held consultations.

During last hearing, the JIT head had raised the issue of hindrances and difficulties the team was facing in investigation. Upon this the bench had asked him to file a separate application over the issue.
