PTI Counsel urges SC to constitute Commission in Foreign Funding Case

Islamabad (May 23, 2017): Pakistan Tehreek-e-Insaf on Tuesday requested Supreme Court to constitute a commission to probe accounts of the party on Hanif Abbasi petition seeking Imran Khan disqualification on the grounds of alleged concealing of offshore companies and receiving foreign findings.

A three-member bench headed by chief Justice Saqib Nisar heard Abbasi’s petition against PTI Chief Imran Khan.

PTI chief’s counsel Anwar Mansoor Khan took the plea that on merit the petition of Abbasi was non-maintainable under Article 184 (3).

He added: “As per the Political Parties Act, if allegations against any party of receiving funds from foreign country or multi-national company proved, the federal government is bound sent a reference to Supreme Court within 15 days.”

He added that the petitioner had sought court verdict to declare PTI a foreign-funded party, while foreign funding declaration can only be given by the federal government. After that the apex court take a decision on the federal government’s reference, the counsel argued.

When the PTI counsel pleaded the court to constitute a commission to probe the foreign funding allegations against PTI, Chief Justice asked the counsel as to why not the matter be referred to Election Commission of Pakistan.

Upon this, Anwar Mansoor replied that the ECP’s jurisdiction ended after allotting electoral symbol to political parties.

The CJP said that the question of jurisdiction will be decided by the ECP itself. He expressed wonder over PTI’s stance of questioning the jurisdiction of SC and ECP on one hands and rejecting the allegation of foreign funding on the others.’

Justice Umer Ata Bandial remarked that the ECP had full power to hold elections as well as investigation.

Later, the court adjourned hearing of the case till tomorrow.

Earlier, the PTI chief submitted details of purchase of Bani Gala lands and banks accounts on the issue of offshore company in the case.
