PTI Foreign Funding Case: SC Resumes Hearing

Islamabad (August 1, 2017): Supreme Court has resumed hearing of PTI foreign funding case from yesterday.

During today’s hearing Chief Justice Saqib Nisar saying that LLCUF collects donations for PTI in the U.S asked PTI’s counsel Anwar Mansoor Khan that  if the LLC (Limited Liability Company) UFA collects funds from prohibited sources does PTI receives it. To this Anwar said that ‘we only have records of those funds only which are sent to us and not the funds that are being collected by the company.’

The Chief Justice further enquired that when funds are collected does the company provides the list while Justice Faisal Arab asked are all the lists are made available on the website. Akram Shaikh, the counsel of petitioner Hanif Abbasi, says that you also receive donations from corporations, Chief Justice asked.

Continuing the Chief Justice commented that a member of National Assembly could not be disqualified for submitting fake certificate vide Political Party Order, however, prohibited funding could be confiscated under the law. The Peoples Representation Act does not talk about facing legal consequences for submitting fake certificates, he added.

Abbasi’s counsel Akram Shaikh argued that PTI submitted rubbish in the court. Sources of funding are asked about all across the world, Imran Khan said that PTI does not accept prohibited funding but taking such funds are being proved here, he added.

When Akram argued that a person who submits incorrect certificate of statement on oath gets disqualified Justice Faisal Arab told Akram that had he filed the election petition on the basis of incorrect  statement on oath the case would have been different. To this Akram replied that on last Friday the prime minister of the country was disqualified by the court for concealing his income.

At this point in time the Chief Justice said, “we are not commenting but if nothing was showed in nomination papers there could be disqualification because concealing assets in nomination papers could lead to disqualification.

Akram argued that one who submits incorrect certificate should also be disqualified.
