SC acquits death row inmate after being behind bars for 10 years

Islamabad (May 22, 2017): Supreme Court on Monday acquitted a man handed down death sentence by a trial court for murdering wife, which was upheld by Lahore High Court, 10 years after being behind the bars.

A three-member bench headed by Justice Asif Saeed Khosa heard appeal of a death row convict.

As per detail, one Muhammad Asif and his mother were booked in a FIR registered at Police Station Barki in Lahore against the murder of Asif’s wife some 10 years ago.

Trial court had handed down death sentence to Asif and released her mother for want of evidence in the murder case. Asif appealed against the conviction in Lahore High Court, which rejected the appeal and upheld the death sentence.

The convict approached the Supreme Court against the rejection of appeal by the high court.  On Monday, a full bench of the apex court headed by Justice Asif Saeed Khosa heard the appeal.

During the course of hearing, Justice Khosa remarked that truth was not being told in the instant matter.  He added that the prosecution had failed to prove its case.

Giving benefit of doubts, the court acquitted Muhammad Asif and ordered his release.

It is to be mentioned here that the Asif had to languish in jail for 10 long years.
