SC declares Hanif Pathan’s appointment as SPSC member illegal

ISLAMABAD: Supreme Court on Monday declared the appointment of Hanif Pathan as member Sindh Public Service Commission as illegal, while it held the appointment of two other members of the Commission;Ghulam Shabir and Sain Dad Solangi, as legal.

A division bench of the apex court headed by Justice Amir Hani Muslim heard the suo motu case regarding appointment of SPSC chairman and members.

The SPSC’s counsel Farooq H. Naek took the plea that appointment of Commission members as per the existing law was not easy. he submitted that appointments in other provinces was almost the same and the court must take suo motu notice of the appointments in other provinces too.

Upon this, Justice Amir Hani Muslim asked Naek to submit an application in this regard, adding the court would issue notice to other provinces too.

Justice Hani said as to why  some five members of SPSC had resigned after the suo motu notice of the apex court. Naek responded that it did not mean all of them were ineligible and incompetent.

After hearing the arguments of the all the parties, the court declared the appointment of Hanif Pathan as member SPSC illegal and appointment of Ghulam Shabir and Sayen Dad Solangi as legal.

The court while issuing directives to the government for appointment of SPSC Chairman and members immediately sought government’s response about the legal status of the work done by the resigned chairman and members  within two weeks.
