Four SC Judges Decline Full Court Attendance, pens letter to Chief Justice

ISLAMABAD: Four Supreme Court judges have refused to participate in the upcoming full court session and have written a joint letter to Chief Justice of Pakistan, Justice Yaqoob Ali Khan.

In the joint letter, Justices Mansoor Ali Shah, Muneeb Akhtar, Ayesha Malik, and Athar Minallah requested that their letter be included as part of the minutes of the full court meeting.

The letter states that although they received the notice for the full court meeting, they are unable to attend. The rules were never approved or discussed before the full court, and the minutes of the meeting should be made public. They expressed the view that the new rules have already faced legality issues.

The judges highlighted that the agenda for the full court was limited to a single point: addressing issues arising from the new rules. They argued that until their fundamental concerns are resolved, participating in this meeting would be of no benefit. The letter also mentions the committee formed by the Chief Justice and notes that the rules were approved through circulation, which is typically used for routine matters.

Finally, they stated that the rules were already notified on August 9, and calling a full court at this stage is “puzzling.”
