Justice Iqbal Chaudhry Upholds Exclusion of Non-Muslim Relative in Inheritance Case

LAHORE: Justice Iqbal Chaudhry of the Lahore High Court (LHC) dismissed an appeal challenging the transfer of inheritance to a non-Muslim relative, reaffirming principles of Islamic law.

The case involved the distribution of 83 kanals of land in Gojra, originally owned by a deceased Muslim man. The property had been divided among the deceased’s Muslim children, but a grandson contested the inclusion of a share for his non-Muslim uncle.

In his ruling, Justice Chaudhry emphasized that Islamic teachings unequivocally prohibit non-Muslims from inheriting the property of Muslims. The court maintained that the decision adhered strictly to Islamic inheritance laws, which govern such matters for Muslims in Pakistan. The LHC upheld the earlier judgment of the lower court, rejecting the appellant’s claims and affirming the exclusion of the non-Muslim
