Islamabad: Justice Qazi Faiz Essa has expressed reservation on the formation of a five member-larger bench for hearing of a Presidential reference for interpretation of Article 63 (A).
Justice Qazi Faiz Essa has written a letter to Chief Justice of Pakistan (CJ) Umar Atta Bandial on the formation of the bench.
In his letter, he adopted a point of view that whole of nation is eyeing on the reference adding that a consultation with senior judge was not conducted for the formation of bench for a vital case.
Justice Qazi Faiz Essa said that senior judges were not included in the larger bench and rules were not followed for the formation of the bench.
He said that judges having seniority of 4th, 8th, and 13th were included in the bench.
As per the content of the letter, senior judge said that senior judges should be added in the bench where an important legal and constitutional questions have been raised.
It is pertinent to mention here that a five member larger bench has been constituted where Chief Justice Umar Atta Bandial will head the bench.
The other judges of the bench included Justice Muneeb Akhtar, Justice Aijaz Ul Ahsan, Justice Mazhar Alam Khan and Justice Jamal Khan Mandokhel.
