Letter of three SC Judges to CJ and Head of Constitutional Bench for benches power case

ISLAMABAD: Three judges of Supreme Court wrote a letter to Chief Justice and the head of the Constitution Bench on the issue of non-determination of the case of bench powers.

Senior Judge Justice Mansoor Ali Shah, Justice Ayesha Malik and Justice Aqeel Abbasi have written a letter to Chief Justice Yahya Afridi and Chief Justice Amin Uddin Khan on the issue of non-appointment of bench powers case in the Supreme Court.

According to the sources in the letter, while mentioning the case related to bench powers, it was said that Justice Aqeel Abbasi was included in the bench on January 16 and Justice Aqeel has heard the case in the Sindh High Court.

According to the sources, the letter also complained about the non-scheduled hearing of the case on January 20 and mentioned the meeting of the Practice and Procedure Committee on January 17.

Justice Mansoor informed the committee that his point of view is on record, Justice Mansoor Ali Shah refused to participate in the committee meeting and said that he does not need to appear in the committee, his order should be followed, said sources

According to the sources, Justice Mansoor said in the letter that the committee could have fixed the hearing on January 20 by forming the first bench, not fixing the case is equivalent to disobeying the judicial order.

Sources says, Justice Mansoor Ali Shah in the letter termed this matter as contempt of court.
