LHC Rejects Petition Regarding Forming Judicial Commission

LAHORE: Lahore High Court (LHC) on Monday rejected a petition seeking the formation of judicial commission over the Sahiwal tragedy while Chief Justice remarked that it was not in the court jurisdiction to form the commission.

Session judge submitted inquiry report of the Sahiwal tragedy before a two-member divisional bench of the LHC chaired by its Chief Justice Sardar Shamim Khan.

Petitioner Jalil consul viewed that it was requested to Prime Minister Imran Khan to form a judicial commission on February 7 but no action was taken adding that he has documentation and arguments that the honorable court can form the judicial commission over the tragedy.

Chief Justice LHC in his remarks said “Do you know who can make the commission and from which laws it can be formed?”

The consul contended that chief minister Punjab had written to chief justice LHC to form a commission for the Model town carnage and he made it.

He said that the JIT on Sahiwal imposed article 302 just on six people while it did not indict IG and other police officers.

The consul said that if the government will form the commission then it will have discretion to the public the report of the commission.

The court said that the judicial commission was formed in the Model town carnage by the Punjab government and asked again the consul “tell me the law on which the court can make the commission.”

As the consul could not mention any law regarding the formation of the commission the court rejected the petition to form the judicial commission for the Sahiwal tragedy.

Brother of Khalil, Jalill and many others have knocked the court doors for the formation of the judicial commission in the tragedy.
