Islamabad: A larger nine-member bench of Supreme Court constituted for hearing a suo moto notice over delay in elections in Punjab and Khyber Pakhtunkhwa dissolved.
The SC larger bench headed by Chief Justice Umar Atta Bandiyal pronounced the verdict on hearing held on February 23.
Four judges, included in a larger nine-member bench for hearing suo moto notice on the delay of elections in Punjab and KP, separated them from the bench.
Chief Justice Umar Atta Bandiyal apprised that four honourble judges parted ways from the bench, besides the bench will continue hearing the case for interpretation of the constitution and the case must have to be concluded tomorrow (Tuesday).
Now bench will be comprised of five judges in chair of Chief Justice Umar Atta Bandiyal, Justice Muneeb Akhtar , Justice Muhammad Ali Mazhar, Justice Jamal Khan Mandukhail and Justice Mansoor Ali Shah.
Four judges Justice Yahya Afridi, Justice Muzzahir Ali Akbar Naqvi, Justice Aijaz Ul Ahsan and Justice Athar Minallah have seperated them from the bench.
Chief Justice said that we will first hear Punjab and later Khyber Pakhtunkhwa while the CJ said that what the constitution has to say it will depend on the intrepretation of it.
He said that we will start the hearing at 9:30 am and will try to end it. The CJ clarified that tomorrow the case must have to be completed.
In its order, the SC said that dissolution of Punjab and KP assemblies constitutional status should be judged.
In the order of court proceedings additional note of Justice Jamal Khan Mandokhel, Justice Mansoor Ali Shah, Justice Yahya Afridi and Justice Athar Minallah are also included.
As per the order, Justice Mansoor Ali Shah raised a question on what reasons the both assemblies were dissolved.
He also questioned that can the assemblies be restored once again, according to the court orders.
Justice Mansoor Ali Shah in his observation said that under the article 184-3 of the constitution, this case should not be heard.
In the order of court proceedings additional note of Justice Jamal Khan Mandokhel, Justice Mansoor Ali Shah, Justice Yahya Afridi and Justice Athar Minallah are also included.
