Objection can’t be raised on delimitation after issuing of election schedule: SC

Islamabad: The Supreme Court (SC) on Monday issued a major decision as acting Chief Justice Justice Tariq Masood said that an objection can’t be raised on delimitation after issuing of the election schedule.

The SC annulling the Baluchistan High Court verdict regarding the delimitation approved the appeal of the Election Commission of Pakistan.

A three member bench of the SC chaired by The acting Chief Justice Sardar Tariq Masood heard appeal against the delimitation on two provincial seats.

Justice Tariq Masood said that he don’t understands why people wanted to delay the elections.

Justice Athar Minallah said that if verdict were given on this appeal then flood of petitions will enter the SC.

Justice Athar Minallah remarked that when the election schedule issued then everything stops adding that it is the biggest test of the ECP that February 8 elections will be transparent.

He said that an authority which given by the law to the ECP then how a High Court can use it?

Justice Mansoor Ali Shah said that after the issuance of the election schedule all the litigation turned ineffective adding that whole of the election process can’t be effected for giving a relief to an individual.

We have to draw a line to set a limit, Justice Shah said.

The Balochistan High Court had changed the delimititions of two provincial seats of Sherani and Zhob.

Over which , the ECP had filed the appeal in the SC.
