Presidential Reference: It Is Written In Article 63 (A) MNA Membership Will End Over Violation Of Party Policy: CJ

Islamabad: Chief Justice (CJ) Umar Atta Bandial of Supreme Court of Pakistan (SC) on Monday said that it is written in the article 63(A) MNA membership will end over going against the party policy.


The five-member-larger bench of the SC resumed the hearing of the Presidential Reference filed by the government seeking interpretation of the article 63 (A) and Supreme Court Bar Association (SCBA) petition to stop the government and the opposition rally in Islamabad.


Lawyers of political parties and SCBA appeared before the court while Attorney General Khalid Javed Khan gave arguments on the interpretation of the article 63(A) .

Attorney General said that disloyalty from the party can not be given positive colour adding that the case is very vital for the parliamentary system.


Khalid Javed Khan said that one or two more hearings will be needed for the conclusion of the arguments.

To which, the CJ said that the case will be heard in the SC Lahore registry on Thursday and Friday adding that sacred month of Ramzan is approaching and hearing after 1 pm will not be possible while he urged the attorney general try to complete his arguments till tomorrow because the court has to listen more lawyers while the CJ apprised that the court will use its written arguments.


The CJ said that the court will hear attorney general for an hour and another hour to other counsels tomorrow.


Continuing his arguments over interpretation of article 63(A), the attorney general argued that the one who wins on a party ticket must have obligation to follow the party discipline adding that if someone not wanted to follow the party lines then he can resign.

He contended the court that one who voted against the party policy should be disqualified for the lifetime.


Justice Aijaz Ul Ahsan said that dissenting to the party is itself suspected action while the CJ said that one has to face consequences over violation of the party policy.

Umar Atta Bandial said that it is written in the 63 (A) that MNA membership will end over going against the party policy.

Chief Justice adjourned the hearing till tomorrow 1 pm afternoon.
