SC adjourns hearing of petitions against Civilians trials in military courts

Islamabad: The hearing of petitions against civilian trials in the military courts adjourned in the Supreme Court by seven member bench.

The SC seven-member bench headed by Chief Justice Umar Atta Bandiyal heard the case. When the hearing adjourned today the arguments of Latif Khosa were continued.

Latif Khosa contended that after imposition of ariticle 245, the authority of high courts under article 199 has ended.

To which Justice Yahya Afridi remarked that summoning of the army notification has withdrawn.
Latif Khosa said that it has been said in formation commanders conference that there are irrefutable facts existed to which Chief Justice questioned that is it said in press release that irrefutable facts exists owing to which trials will be held in the military courts? Latif Khosa replied that yes it is said in the press release.

The court also asked Latif Khosa that are these documents exists on Inter Service Public Relations (ISPR) web site. To which Latif Khosa replied in affirmative.

Latif Khosa also apprised the court that no any single soldier sustained injury in the attack on the corps commander house or Jinnah house on May 9th.

Justice Mansoor Ali Shah remarked that all this are statements, show us where trials started in the military courts.

To which Latif Khosa started reading verdicts of anti terrorism court (atc) and told the court as well that actions have been started in the military courts.

Justice Ayesha Malik remarked that military persons can be handed over to the military courts while civilians can’t be handed over to it. On which Latif Khosa said that this matter is our case that civilians can’t be tried in the military courts.

Justice Muneeb Akhtar questioned that is an anti terrorism court can pronounce verdict that this case is of military act or not.

He said that civilians have right to approach high court for basic human rights in the military courts adding that the matter of basic human rights can bring into the Supreme Court.

The hearing of the case adjourned until tomorrow.

Earlier, at the start of the hearing in the morning Justice Qazi Faez Isa raised objections on the nine-member bench and refused to be part of the bench and Justice Tariq Masood also agreed with the Justice Qazi Faez Isa.

After which the nine-member bench dissolved.

Chief Justice Umar Atta Bandiyal announced a new seven-member bench for hearing petitions against civilians trials in the military courts.
