SC allows civilians trials in military courts

Islamabad: The Supreme Court of Pakistan (SC) on Wednesday allowed trials of civilians in the military courts suspending earlier verdicts in the case.

The SC larger bench comprising six judges awarded the verdict by the majority of 5 to 1. Justice Musarat Hillali opposed the majority verdict.

The larger bench headed by Justice Tariq Masood heard an intra-court appeal over annulling the verdict of civilians trials in military court.

The defence ministry counsel Khawaja Haris said that nothing written in the earlier verdict, the sections of the army act is unconstitutional under which sections of the constitution.

Justice Muhammad Ali Mazhar questioned that what is your opinion about a transparent trial? How will you ensure a fair trial in military courts?

Khawaja Haris said that the Indian spy Kulbhushan Yadev also consider among the civilians. He urged that sections relating to civilians can’t be annulled.

Sardar Latif Khosa opposing the prohibition order said that the judges who awarded the verdict of the military courts are also part of this court.

Attorney General Mansoor Usman Awan insisted to allow conditional holding of civilians trials in the military court.
