ISLAMABAD: The larger bench of Supreme Court of Pakistan (SC) hearing a petition against supreme judicial council has been dissolved after two of the judges of the bench refused to hear the petition.
Justice Sardar Tariq and Justice Aijaz Ul Ahsan refused the hearing while Justice Umar Atta Bandial said that few judges of the bench are feeling that they should not be part of the bench.
Regarding his refusal Justice Sardar Tariq said he didn’t say no to hearing after objections raised by the Justice Essa counsel but he has been feeling to say no to hearing since morning saying even if the petition is rejected then there is nothing in it for judges.
For the formation of a new bench the case has been sent to Chief Justice Supreme Court Asif Saeed Khosa.
Earlier, a large bench of the SC headed by Justice Umar Atta Bandial had heard the petition against Supreme Judicial Council while Munir A Malik had appeared before the court as a counsel of Justice Faiz Essa.
Munir A Malik raising an objection on the bench had said that some judges of the bench should refuse hearing of the case adding that the bench should be form that include only judges who are not part of the Supreme Judicial Council.
On which, head of the bench Justice Umar Atta Bandial asked which factors tantamount to proving Judge’s partiality? while he said that every judge of this apex court performs his duties as per law and constitution while no any judge of this bench has any interest in any case.
Justice Atta referring to Justice Munir said that “talking of judges partiality you are taking wrong direction.”
Justice Essa counsel contended those judges who have to be chief justice in future have interest adding that two judges of this bench will be chief justice in future and there salaries will be increased after becoming chief justice.
Justice Umar Atta Bandial said that “you have to make judiciary strong, don’t raise objections on any judge while objection will damage people trust on the judiciary while these objections are nothing but opening the door of rumors.”
He said that someone has to be chief justice in 2025 asking Justice Muneer that “is he wanted that future judge refuse hearing.”
