Islamabad: Supreme Court of Pakistan (SC) on Tuesday declared Sindh government local act para 74 and 75 null and void in MQM-P petition regarding powers of local bodies while the court also ordered the Sindh government should ensure that all laws are in accordance with Article 140A.
Chief Justice Supreme Court of Pakistan Gulzar Ahmed on his last day as the CJ announced the verdict reserved on October 26, 2021.
As per the verdict, making of a master plan and implementation on it are the powers of the local bodies adding that no any new project could be initiated by the provincial government.
According to the verdict, Sindh government is obliged to keep good relations with the local government.
The top court also ordered to make laws of Sindh Building Control Authority (SBCA) act and laws of Karachi Development Authority as per the constitution while he also directed to change laws of Malir Development Authority (MDA), Hyderabad Development Authority (HDA) as per the constitution.
It is directed in the verdict that amendments be made as necessary in Lyari Development Authority (LDA), Water Board, Sehwan Development Authority (SDA) and Larkana Development Authority (LDA).
The CJ verdict further directed that paras of the law regarding local government laws be changed wherein contradiction found in the powers of the provincial government and the local government.
The verdict also clarified that ensure implementation on the provincial finance commission.
