In the written decision of the Supreme Court, it was said that the dispute between the President and the Election Commission was unnecessarily brought to the Supreme Court. In the Constitution and the law, the court not have the authority to set the date of the election, Facilitated the determination. The people have the right to have elections and the court had the honor of ensuring the election. After the agreement with the president, the notification of the date of the elections has been issued. The federal and provincial governments should ensure that the process of elections takes place on February 8. to be completed without any interruption.
The court said in a written decision that in the recent past, the same president dissolved the assembly when the prime minister was facing no-confidence. The constitution is clear that the assembly cannot be dissolved in the case of no-confidence. The dispute over the dissolution of the assembly came to the Supreme Court. And the court had to decide, the constitution is not an option but a responsibility. The higher the constitutional position, the greater the responsibility. The president, chief election commissioner and members are bound by the oath taken under the constitution. If any institution interferes with the constitutional boundaries of another, the consequences will be serious.
Supreme Court further said that fifteen years ago on November 3, the Constitution was bloodied on the night. The judgment further said that the court recognizes the role of the media under Article 19, but some consider this freedom as a license to give false information to the public and create a false narrative.
