SC Issues Contempt of Court Notice to Nehal Hashmi

Islamabad (June 1, 2017): The Supreme Court on Thursday issued contempt of court notice to Pakistan Muslim League-Nawaz (PML-N) leader Nihal Hashmi in suo motu case regarding his incendiary speech threatening those investigating the ‘Prime Minister’s son’.

Hashmi, in a speech surfaced yesterday, had threatened those grilling the Prime Minister’s son of consequences.

The Supreme Court had taken suo motu notice of the speech and had asked him to appear before the three-member special implantation bench of the apex court.

The three-member special implementation bench heard the suo motu case on Thursday.  Nihal Hashmi and Attorney General for Pakistan (AGP) appeared before the bench on notice.

At the outset of the hearing, Nihal Hashmi tendered unconditional apology to the bench over whatever he had uttered in his speech.

However, the court rejected his apology and decided to initiate contempt of court proceeding against Hashmi.

During the course of proceeding, the members of special bench expressed their anger and anguish over the threats, which, they said, were directed at the judges not the JIT.

Justice Azmat Saeed Sheikh while addressing AGP said that their children were not even threatened during martial law.

“Congratulations Attorney General sahib, your government hurled threats at our children and joined mafia and terrorists who used to threaten children,” Azmat Saeed remarked.

Presiding judge Justice Ejaz Afzal Khan said that they were working as per law and constitution, adding that whosoever malign and disrespect the court action would be taken.

During the hearing, Justice Azmat Saeed stopped AGP from speaking, and told him “Your government is creating problems for us”.

“We have braved martial law and even during martial law our children were not threaten of dire consequence. We faced Nov 3, 2007 but not faced such a situation,” he added.

He observed that it seemed someone else was speaking in Hashmi’s voice. He added that in the country people even did not hurl threats at children of their enemies. “AGP Sahib! Do you know who threaten children,” Justice Azmat asked. The AGP replied that coward people threaten children.  “No, mafia and terrorists use to threaten children and congrats AGP sahib your government also joined the league of mafia and terrorists by doing so,” the judge remarked.

Justice Ejazul Hassan while addressing Nihal Hashmi said: “You did not do this against the JIT rather the judges.”  He observed that an organised campaign was going on against the JIT and judges.

Justice Ejaz Afzal said that they knew well what were happening outside. “Neither we are afraid of anyone nor worried about the consequences,” he remarked.

He added that the JIT was constituted by the court and Registrar made the call to SECP chairman on our instructions.

He added that during the hearing of Panama case the court had asked to shun the ‘setting up of court’ outside the SC.

Hashmi while addressing the bench said “I tender unconditional apology and could not imagine to say whatever said that day.”

But the bench while rejecting his apology asked him to submit reply to the show cause notice issued to him. The bench asked him to say whatever you want in response of the notice.

During the hearing, the court asked AGP to gather relevant materials to initiate contempt of court proceeding against Hashmi.

The court also asked the AGP to decide as to which provisions of criminal law should be invoked against Hashmi.
