Islamabad: The Supreme Court of Pakistan (SC) on Friday issued notices to ex-dg Inter-Service Intelligence chief (Lt gen retd)Faiz Hameed and brigadier Irfan Ramay in the case of sacking of judge Shaukat Siddique.
A larger five-member bench headed by Chief Justice Qazi Faez Isa heard the Shaukat Aziz Siddiuqe sacking case.
The SC hearing of the sacking of justice Shaukat Aziz Siddique case also issued notices to ex registrar of the Islamabad High Court (IHC) Muhammad Anwar Kansi, ex registrar SC Arbab Muhammad Arif as well.
The top court didn’t issue notices to ex army chief general Qamar Javed Bajwa, Tahir Wafai and brigadier Faisal Marwat .
During the course of the hearing the CJ questioned petitioner counsel “apprise the court after complete thinking that are your allegations true?
The CJ asked further had that generals, who you wanted to be made respondent, wanted to join the power corridor after elections of 2018?
To which the counsel Hamid Khan said that his allegations hurled are true.
Chief Justice Qazi Faez Isa remarked that egregious allegations that were hurled and their repurcussions will also be serious.
The CJ said that we will not allow SC to be used for someone purpose for acheiving any goal.
Justice Qazi Faez Isa said that if fecilitators have made respondents then why didn’t beneficiaries?
He remarked that it seems from your allegations that real purpose was to make someone a prime minister adding that had there was purpose to keep a man in jail to make a person of someone choice to become premier?
A real beneficiary is someone else adding “You are making facilitators as respondents”, the CJ said.
One person is sidelined so that person of someone choice win an election, the CJ added.
Hamid Khan said that it has been happening in the country for last 70 years, on which, Justice Jamal Mandokhel remarked that did’nt conduct reddressal for what’s has been happening in the country for 70 years?
The CJ said that when you will come to the court so we will follow the constitution adding this is not an easy path.
Justice Mandokhel remarked that it is being tried to use our shoulders and you said that people here used like an equipment adding that what happened in the past we have to redress it.
The CJ said that the problem is that no any institution in the country wanted to do their work.
The SC issuing notices to respondents sought reply from them.
The hearing of the case will resume after winter vacations. While the next date of the hearing will be set after seeing availability of the judges.
