Islamabad: The Supreme Court on Tuesday rejected the Capital Development Authority (CDA) report on constructions on the land of Margalla Hills National Park while annulling all the lease whereas it is also ordered to remove all restaurants including Monal at National Park Pir Sohawa road within a hiatus of three months.
A three-member bench headed by Chief Justice (CJ) Qazi Faez Isa heard the case.
The CJ said that commercial activities can’t be allowed in the National Park while the court declared that if any lease needed outside the park then give preference to the affected restaurants.
The CDA counsel said that we have provided the report comprising all the details of the construction in the national park.
The CJ rejecting the report said that a sports club, the Pakistan-China center also included in the report.The CDA has also included the arts council, the national monument, the CJ remarked.
The CJ questioned that do we order bulldozing the national monument and sports club? Is it honesty of the CDA? the CJ questioned.
He asked again is the CDA office also situated in the national park? and we order to remove it as well.
He said that world knows how many restaurants are there along with the Monal restaurant.
Only the CDA didn’t know about it? he questioned.
On the order of the SC, Chairman CDA appeared before the bench and he apprised that 21 times fire erupted in this season in the mountains of Margalla.
The CJ qeustioned, do the CDA people themselves ignited the fire while the CDA chairman informed that some black sheeps are present in the department.
With the approval of the cabinet helicopter was taken from the National Disaster Management Authority (NDMA), the CDA chairman apprised.
The Monal restuarant management ensured the top court for volunteerily shifting the resaturant.
The CJ said see all around the world there is no restaurant in the national park.
The CJ said that our aim is to ensure protection of the national park adding that all the unnecessary notices served to all the restaurants are ended except the national park.
