SC rejects petitions against practice and procedure act 2023, act to retain

Islamabad: After assuming charge of the top Judge of Supreme Court of Pakistan, Chief Justice Qazi faez Isa along with full bench of the court rejected all the petitions against the practice and procedure act 2023 while five judges of the full bench opposed the verdict.

Chief Justice read the verdict in front of the court.

The SC has announced the verdict with a majority vote of 10 judges.

The CJ pronounced a short verdict. Whereas the top court decided to retain the act with a proportion of 10-5 .

On the other hand Justice Aijaz Ul Hassan, Justice Muneeb Akhtar, Justice Muzahir Ali Naqvi, Justice Shahid Waheed and Justice Ayesha Malik opposed the act.

Later, Supreme Court of Pakistan issued a short verdict of the practice and procedure act 2023 after the full court pronounced the judgement in the favor of the act.

According to the short verdict, the practice and procedure act 2023 will not be applicable from the past. The SC rejected the clasue regarding applicability from the past by a majority of 8-7.

Chief Justice Qazi Faez Isa, Justice Sardar Tariq and including Justice Mansoor Ali Shah supported the act applicability from the past.

The full court retained a right of appeal clause in a cases under a sou motto notice 184 (3).

Earlier, hearing of the practice and procedure act 2023 completed on Wednesday at Supreme Court of Pakistan (SC).

The full bench headed by Chief Justice Qazi Faez Isa resumed the hearing today.

Chief Justice Qazi Faez Isa said that if consensus developed then verdict will be announced today. If in case consensus not reach then the judgement be understood preserved.

During the course of the hearing the honourable CJ said that a burden of proving the practice and procedure act clauses unconstitutional are on the petitioners.

” I wanted to admit that it was my mistake to form a full court for hearing of the practice and procedure act 2023.”
