Islamabad: Supreme Court on Friday rejected a stay order petition against the auction of properties of Bahria Town.
A three-member bench headed by Justice Amin Uddin conducted the hearing of the petition.
The top court ordered a counsel of the Bahria Town to submit copies of references against the Bahria Town.
Head of the bench Justice Amin Uddin remarked that a decision regarding the stay could not be taken hearing only one side but it will be decided after hearing both the sides.
He said that various petitions were heard today while a central petition not filed yet.
Justice Naeem Akhtar Afghan said that the accused had conducted a plea bargain with the National Accountability Bureau (NAB) while eight properties were given to the NAB under the plea bargain.
Now the accused said that the plea bargain was not voluntarily but was made under the pressure. While an application has been given to the NAB Chairman for ending the plea bargain.
Justice Naeem Akhtar Afghan said that after the application the case returned to an initial phase. While the properties could not be confiscated untill punishment not served on the petition.
He questioned, how did the NAB forward towards auction? he directed to attach the NAB references copies along with the central appeals so that it could be known what is the misappropriation.
The counsel of the Bahria Town said that this is my case while our petition for ending the plea bargain and the NAB reference are both pending.
The court adjourned the hearing till August 13.
Central and various petitions will be heard on the next hearing.
