SC reserves judgement in formation of election tribunal in Punjab case

Islamabad: The Supreme Court on Tuesday reserved the judgement in the case of regarding formation of election tribunal in Punjab .

A five-member bench headed by Chief Justice (CJ) Qazi Faez Isa heard the case for forming of the election tribunals in Punjab on the appeal of the Election Commission of Pakistan (ECP).

The ECP counsel, lawyer Salman Akram Raja and Hamid Khan appeared before the court.

On the onset of the case, Hamid Khan counsel of Salam Akram Raja raising objection on the CJ Qazi Faez Isa said that we have an objection over your hearing of the case. To which the CJ said that if you wanted to seperate yourself them let it do, we have no any issue.

During the hearing Justice Aqeel Abbassi remarked that according to the ECP written reply the problem resolved with the consultation with the High Court.

To which, the counsel of the ECP apprised that yes sir you are absolutely right, Chief Justice Lahore High Court (LHC) retained four tribunals and after change of law remaining four will be designated by the ECP.

Justice Qazi Faez Isa said that the matters which not belonged to the court, resolve these matters with each other.

The CJ said that he has tired saying again and again that what the constitution says the constitution is a book of law and no one like to read the constitution.

Justice Jamal Mandokhel remarked that the ECP has a authority but appointments of judges in the election tribunals happen with the consultation with the high courts.

He said that the talk of likeness and dislike should be end regarding judges appointments in the tribunals.

Justice Qazi Faez Isa said that the number of tribunal depends on cases, take decision of number of judges while seeing the cases, if number of judges are less in number as compare to cases it will be injustice.

He said that he didn’t know how many cases are pending in Baluchistan and Punjab.

Moreover , the top court reserved the verdict regarding formation of election tribunals in Punjab which will be pronounced later.
