SC reserves verdict in petitions against trials of civilians in military courts

Islamabad: The Supreme Court (SC) on Monday reserved the verdict in the petitions against trials of civilians in military courts.

The SC larger five-member bench headed by Justice Aijaz Ul Ahsan,comprising Justice Munib Akhtar, Justice Yahya Afridi, Justice Sayyed Mazahar Ali Akbar Naqvi, and Justice Ayesha Malik heard the petitions against the trials of the accused in the military courts.

The top court said that if we were returned today then will issue a short order if not then we will give a date to issue a short order.

Attorney General Mansoor Usman Awan apprised the court why the military courts were established in 2015 through a constitutional amendment.

The attorney general said that he will inform the court also that why there is no need of a constitutional amendment for the military courts now?

Justice Aijaz Ul Ahsan asked “who were they who tried in the military courts in the past?”he kept on asking “were the accused of 2015 common citizens, foreigners or terrorist?”

Mansoor Awan apprised that they were both local and foreigners adding that those who were tried in the military courts in 2015 also included facilitators of the terrorists.

He informed the court that accused will be tried under the official secret act section 2 (1) D.

He said “I was asked that how charge will be framed.” He apprised that all the necessities of civilians trials will be fulfilled in the trials under the army act.

He further added that trials of the May 9 accused will be conducted on the pattern of civilians court.

He furthered that reasons will be given in a verdict while evidences will be recorded.

Under the article 10 A of the constitution all the necessities of the transparent trial will be fulfilled, he informed.

At last, he apprised that later appeal can be filed in the high courts and the SC.
