Karachi: Sindh High Court (SHC) on Tuesday postponed hearing of Jamat-e-Islami (JI) petition against legislation over direct election of mayor untill tomorrow while the court rejected advocate general Sindh insistence to postponed the hearing for one week.
Pakistan People’s Party (PPP) candidates for mayor elections including Murtaza Wahab have filed petitions to become party against Hafiz Naeem Ur Rehman petition challenging Sindh Assembly (SA) law of electing the mayor directly.
Murtaza Wahab counsel adopted the view that tell us only one single section of the constitution which has been violated. After elections non elected persons inclusion para was added.
To which the JI’s counsel said that it is clear in Sindh Local Government act number 2 that elected members will be candidate. While any person who was not the part of any phase of election will not be candidate.
The JI advocate further said that conducting legislation of such type just few days before the mayor election is against the spirit of constitution and law.
If after six months he could not become UC chairman then he never become a mayor ? In the amendment this matter has been kept unclear adding that for becoming mayor he should be part of the whole election process.
Counsel of another PPP candidate Salman Murad, Shabir Shah said that the legislation in the direct election of mayor can not deprive anyone right.
The court adjourned the hearing till June 14.
