The Senate passed a resolution against the Supreme Court’s decision regarding the amendments to the Army Act

Islamabad: The resolution against the decision of the Supreme Court was presented by Senator Dilawar Khan in the House, the Senate passed the resolution against the decision of the Supreme Court by majority vote

The resolution said that the trial under the Army Act against those who attacked the Pakistan Army is within the constitutional and legal scope. The resolution said that the Senate stands with the families of the martyrs. The families of the martyrs have expressed feelings of insecurity and betrayal over the decision. In the resolution passed by the Senate, it was said that the Supreme Court did not take into account the non-arbitrariness of the punishments given by the military courts, the Supreme Court did not take into account the issue of adopting the prevailing procedure in the military courts, against the punishments of the military courts. The matter of appeal before the Army Chief and the President was not taken into consideration, the matter of petition in the High Court against the sentences of military courts was also not taken into consideration, the right to a transparent trial under Article 10A of the Constitution in the Army Act, Army Act The relevant clauses of the Act do not violate the Constitution during the trial.

The resolution demanded that the decision should not be implemented until a larger bench reviewed it. The decision of the bench was not unanimous. The decision against the courts will promote terrorism, the people involved in the May 9 incident should be tried in the military courts, the parliament had allowed the military courts, the decision is an interference in the authority of the parliament. 

People’s Party Senator Raza Rabbani and Jamaat-e-Islami Senator Mushtaq Ahmad protested against resolution.
