Islamabad: The federal Shariat Court on Wednesday has given verdict that a wife after taking Khulla from her husband bound to pay haq mehar received from her husband at the time of a marriage.
The three member bench headed by Chief Justice of the federal Shariat Court, Justice Noor Muhammad Maskan Zaye and Justice Dr Syed Muhammad Anwar and Justice Khadim Hussain M Sheikh other two judges of the bench announced the verdict.
The federal Shariat Court declared amendments conducted in 2015 in Punjab family court article 10 and sub article 5 and 6 null and void.
As per the verdict, returning of 25 percent of haq mahar in case of khulla has been declared against the Sharia.
The court has ordered the women that they return their haq mahar to their husbands whom they want divorce in the period of khulla.
The Islamic Court further added that if a man leave his wife then he has to pay haq mehar to his wife.
The court verdict will be applicable from May 2022.
Earlier, the court had given verdict after hearing the petitions of four men, who initiated legal process to receive their haq mahar from their house wives.
