Islamabad: The Supreme Court of Pakistan (SC) on Wednesday gave its opinion in the Zulfiqar Ali Bhutto presidential reference while the top court of the country declared that former premier didn’t get fair chance of trial.
A nine-member larger bench of the Supreme Court headed by Chief Justice (CJ) Qazi Faez Isa heard the case.
The SC had reserved its opinion and pronounced it today.
The CJ said that the SC opinion is consentient while he apprised that the top court was asked five questions in the reference.
The SC declaring the second question in the reference as uncleared the SC said that they can’t give their opinion.
The first question was had the trial was according to the constitution’s basic human rights? second one was the verdict can be a precedent? Besides that questions were asked regarding trial being neutral or not, was the verdict correct according to the instructions of the Quran and were evidences enough for the pronouncing the verdict.
The SC clarified that the second question asked in the reference was not clear so the opinion can’t be given.
The top court also clarified that we can’t review evidences of the case adding that no any party assisted the court on the Islamic principles.
The opinion can’t be given whether the verdict was per the Islamic principles or not, the SC said.
The CJ said that the SC will issue causes in details later. The CJ went on to say that we judges are bound to take verdicts according to the law and judges decide cases indiscriminately.
The top court also clarified that there is no constitutional and legal option available to change the sentence of Zulfiqar Ali Bhutto.
