ISLAMABAD: The Federal Constitutional Court has affirmed that pension and related retirement benefits are a basic legal right of employees, ruling that such payments must not be withheld without an order from a competent court. The landmark nine-page decision, authored by Justice Arshad Hussain, emphasizes that any undue delay in disbursing pensions violates legal protections and infringes upon the rights of retirees.
The court clarified that pension is not a discretionary privilege or favor granted by employers, but a rightful entitlement earned through years of service. It underscored that retirees are entitled to receive their pensions and benefits promptly, unless a court with proper jurisdiction has issued a specific order to withhold them.
Addressing previous rulings, the judgment referenced multiple Supreme Court decisions condemning delays in pension payments, warning that ignoring court directives regarding pension disbursements could constitute contempt of court.
The ruling also touched on the finality of legal proceedings, stating that when an appeal or review is not filed within the prescribed timeframe, the original court’s order becomes conclusive and enforceable. The court made it clear that parties who fail to seek review in time cannot later challenge the same order through constitutional petitions, emphasizing that legal disputes must reach a definitive resolution and not be reopened repeatedly.
This decision was delivered in a case involving Muhammad Akram, a daily-wage driver dismissed by a private bank. Despite a Labour Court order for his reinstatement along with benefits, the ruling remained unfulfilled for 17 years. The court described this prolonged neglect as unacceptable and ordered the immediate implementation of the Labour Court’s decision, including reinstatement and payment of all due benefits.
The judgment reaffirmed that both public and private sector employers are legally obligated to comply with final court orders and cannot deny employees their lawful retirement or service benefits through administrative delays. This ruling is expected to bolster legal safeguards for retirees and reinforce the duty of employers to disburse pensions and dues without unnecessary postponement.
