Imran Khan’s application approved, notification of court appearance through video link invalidated

Lahore: High Court quashed the notification to present PTI founder Imran Khan in the Anti-Terrorism Court (ATC) through video link.

Two member bench headed by Justice Tariq Saleem Shiekh issued a detailed written decision on the application regarding the appearance of Imran Khan through video link at ATC.

The court declared the notification of the Ministry of Interior to present the physical remand to the ATC on video link as illegal and said that according to the law, the matter should have been presented before the Cabinet, under the terrorism laws, the notification cannot be issued individually under terrorism laws.

In the High Court’s judgment, it is written that the Ministry of Home Affairs of Punjab issued a notification to present it on video link without the approval of the Cabinet. Crimes under the Anti-Terrorism Act are extremely dangerous, but the Constitution speaks of the fundamental rights of the accused, physical remand.

In the detailed decision of the Lahore High Court, there have been many amendments in the ATA law, but there has been no change in Section 21E of physical remand. Cannot be served on remand via video link.

In the judgment, it is written that the court declares the notification of the provincial interior ministry dated 15th July 2024 to present the founder PTI Imran Khan on video link invalid and the request of the founder PTI is approved.
