SC Maintains ECP’s Notification of Ban on Recruitment

Islamabad(May 12, 2018): Supreme Court of Pakistan has suspended decision of Islamabad High Court (IHC) to cancel notification of Election Commission of Pakistan (ECP) regarding recruitment in government offices.

According to the details, the court during hearing maintained ECP’s notice and banned new appointments and development schemes until general elections.

The top court has also summoned Election Commission of Pakistan and other officials to Islamabad in next hearing.On May 11, the Election Commission of Pakistan had challenged Islamabad High Court (IHC) judgment of removing ban on posting, transfer and new development projects which was imposed by it on April 11.

The Election Commission of Pakistan (ECP) on April 11 imposed a ban on recruitment of public servants in federal, provincial and local government institutions, however just after a month the Islamabad High Court (IHC) has lifted ban.In its petition challenging IHC verdict, ECP stated that the decision to impose ban on posting and new development projects was aimed to provide equal level field to all political parties and candidates for the next general election.

On April 24, SC gave  the Islamabad High Court (IHC) one week to decide on the Election Commission of Pakistan (ECP) decision to ban recruitment in government institutions during 2018 polls.

The ECP secretary informed the apex court that they halted recruitment of government jobs to prevent pre-poll rigging and clarified that the federal and provincial public service commissions have been exempted from the order.The court ordered that the Punjab government’s writ petition against the ECP order should be transferred to the IHC where a two-member bench will decide it in a week.

Justice Aamer Farooq will head the bench and conduct proceedings daily, it stated further, adding that until then, the ECP decision will remain in place.

The court also ruled that any province which wants to challenge the decision may file a writ in the IHC.
